General Terms

1. Our Services

We provide project development, guidance, and support for hardware and software projects as per the mutually agreed plan. At the project starting stage, 1 PPT and 1 Synopsis in generalized form will be provided for initial approval purposes. After this, no free modifications will be accepted, and the client must include their personal and academic information in those documents as required by their institution. During the project work duration, clients will receive regular updates, progress demonstrations, and expert support for doubts or clarifications. At the time of delivery, clients will receive the complete project package including the working project (hardware/software), source code, and 1 time Report (soft copy). Any additional work or changes outside the agreed scope may incur extra charges. Research paper writing and publishing are not included in the project cost; clients who require this service must request it separately with additional payment.

2. Client Responsibilities

The Client shall provide all necessary project details, data, documentation, and materials in a timely and complete manner, which are essential for the successful completion of the project or service. IT Educations shall not be held responsible for any delays, errors, or shortcomings arising from incomplete, inaccurate, or late submissions by the Client. The Client also acknowledges that IT Educations does not provide any software licenses required for the project; procuring and providing all necessary software licenses is the sole responsibility of the Client or student.
The Client must communicate any additional requirements, revisions, or modifications to the agreed scope of work at least thirty (30) days prior to the desired implementation. Requests received after this period may incur additional charges and/or extended delivery timelines at the sole discretion of IT Educations.
The Client is required to respond promptly to all communications, queries, clarifications, and approval requests from IT Educations. Any delay, non-response, or partial response from the Client shall be considered the sole responsibility of the Client and may result in project delays or suspension of work, for which IT Educations shall bear no liability.
The Client must ensure that all data, materials, documents, or content provided are accurate, lawful, and free from any copyright, trademark, or intellectual property infringement. The Client shall bear full legal responsibility for any consequences arising from the use of such materials. IT Educations shall not be held liable for any claims, disputes, or legal actions arising from unauthorized or illegal content provided by the Client.
The Client is obligated to complete the official online project registration form at the time of making the project registration payment. The Client or student must explicitly mention the project Project Description / Abstract / objective in writing on the registration form. No verbal communication will be accepted. All work done will be considered valid only as per the written instructions. No discussion, modification, or request outside of the written instructions will be entertained after submission. If the Client attempts to make such changes or discussions later, IT Educations reserves the right to stop the project immediately or charge additional fees at its discretion.
Only the Client who has completed the registration form is authorized to communicate with IT Educations regarding the project. IT Educations will refuse communication with any unauthorized individual. Any insistence by third parties to communicate may incur additional consultation fees at the discretion of IT Educations.
The Client acknowledges and agrees that failure to comply with the above responsibilities may result in project delays, suspension of work, termination of services, or additional charges without any liability or obligation on the part of IT Educations. The Client shall bear sole responsibility for all consequences arising from non-compliance.

3. Client Acknowledgement & Agreement

By availing our services (projects, training, or guidance), the Client confirms that they have read, understood, and agreed to all Terms & Conditions.
No claims of unawareness or misunderstanding will be entertained once the service has started.

Payments & Charges

4. ⚡ Payments ⚡

Hardware Projects:

A minimum of 50% advance payment must be made before the commencement of the project work.
The remaining 50% payment is due immediately upon project completion and before final delivery or handover.

Software Projects:

30% advance payment is mandatory before starting the project.
30% must be paid after completion of the first milestone or partial delivery.
The remaining 40% must be cleared at the time of final project delivery.

General Payment Terms:

All payments must be made as per the above schedule unless otherwise agreed in writing by IT Educations.
If the Client requests to divide the total payment into more than three (3) installments, such arrangements shall attract an additional administrative charge or penalty and may cause delays in project development or delivery timelines.
Delay in payments beyond the agreed schedule may result in the suspension of ongoing work until dues are cleared in full.
All payments must be made through officially approved payment methods (UPI, bank transfer, etc.) as communicated by IT Educations.
If the Client or Student wishes to obtain 70% to 80% of the project work (including partial delivery, demo, or code access), they are required to make 100% of the total payment in advance, without any arguments or exceptions.

Important:

All payments are non-refundable and non-adjustable under any circumstances.
Late payments may delay project progress or attract additional charges.

5. Non-Refundable Payments

All payments made to IT Educations or the Owner of this firm are strictly non-refundable and non-transferable under any circumstances, irrespective of project status, progress, delivery stage, or the Client’s level of satisfaction.
Once a payment is made, it shall be considered final and binding and cannot be modified, cancelled, adjusted, or credited toward any future project, service, or account.
The Terms & Conditions link will be clearly mentioned on our UPI and other payment pages. It is the Client’s sole responsibility to read and understand these terms before making any payment.
If a Client makes payment without reading the Terms & Conditions, it will be deemed that they have voluntarily accepted all terms. Any argument, refund request, or dispute raised after payment completion shall be considered invalid and unacceptable.
By initiating payment, the Client expressly agrees to these conditions and waives any right to claim, chargeback, or legal objection related to payment or refund.

6. Urgent Project Charges

Projects requested with a completion timeline of 1 to 10 days will be considered urgent.
Urgent projects will be charged double due to increased workload and priority scheduling.
The Company reserves the right to decline urgent projects based on availability.

Project Workflow

7. Project Delivery

Estimated delivery timelines will be shared in the project plan.
Delays due to late submissions or incomplete inputs from the Client will affect timelines.
Timelines may also be impacted by unforeseen events such as technical issues or natural calamities.
Project Report / Thesis Delivery: A soft copy of the project report or thesis will be provided within 3–15 days after the final project delivery. The report/thesis will be in a general format and limited to 20–30 pages. Any customization, extended content, or additional formatting beyond this scope will be chargeable. A free soft copy will be provided only for projects costing more than Rs. 10,000/- (excluding hardware price in case of hardware-based projects); for projects below this price, the Project Report / Thesis will be chargeable.

8. Revisions

Minor fixes and reasonable adjustments are included.
Major changes outside the original scope will incur additional charges.
Revision requests must be made within the agreed review period.

9. Project Scope Freeze

Once the project scope is finalized and the first phase has begun, no major changes will be allowed without scope renegotiation.
Any major change request will lead to a scope revision document and additional cost estimate.

10. Client-Initiated Pauses

If the Client pauses the project for more than 14 days, a restarting fee may apply.
In case of inactivity exceeding 30 days, the project will be considered abandoned, and no refunds will be issued.

11. Post-Delivery Responsibility & Collection

IT Educations shall not be held responsible for any issues arising after project delivery, including but not limited to errors, data loss, malfunction, or damage to hardware or software.
All project data, materials, and resources are provided strictly for educational and academic purposes only. Any misuse, replication, or application of the project for commercial, unethical, or non-educational purposes shall be the sole responsibility of the client.
IT Educations will not be liable for any legal, technical, or financial consequences resulting from the misuse or unauthorized use of the delivered project or its components.
The client must collect the project immediately upon completion. Failure to collect the project on time may result in additional storage or handling charges.

Communication & Support

12. Communication & Office Hours

Response time is 24–48 working hours. Instant replies are not guaranteed.
Working hours exclude Sundays and public holidays.
Calls or messages on off-days will incur a penalty of ₹1000, added to the project cost.

13. Support & Maintenance (Post-Delivery)

Once the project has been delivered and approved, IT Educations shall not be obligated to provide any free support, updates, or modifications unless it is explicitly included in the agreed project scope or documentation.
Any requests for technical assistance, troubleshooting, bug fixing, maintenance, or feature enhancement after delivery shall be treated as paid services and will be charged as per the prevailing rates of IT Educations.
IT Educations will not be responsible for issues arising due to client-side modifications, third-party software, or hardware/environmental changes made after delivery.
Clients are advised to verify and approve all functionalities before final acceptance, as post-delivery changes or rework will incur additional charges.

Hardware & Technical Terms

14. Hardware Damage & Replacement

The Client or student shall be fully and solely responsible for any hardware damage, malfunction, burning, or non-functionality occurring at any time, including during the project work. The Client shall bear all costs associated with repair or replacement of such hardware, regardless of the circumstances.
IT Educations shall not be liable under any circumstances for any damage caused by misuse, mishandling, improper installation, short circuits, voltage fluctuations, external environmental factors, or any situation beyond our direct control.
Any replacement, repair, or service undertaken by IT Educations shall be charged to the Client at prevailing market rates. IT Educations reserves the exclusive right to choose the replacement method, vendor, or service provider at its sole discretion, without any liability for alternatives suggested by the Client.
The Client acknowledges and agrees that even if the hardware damage occurs during the project work, it shall remain the Client's full responsibility and IT Educations shall bear no financial, legal, or operational liability for such incidents.

15. Component Availability & Pricing

All hardware component prices are subject to market fluctuations, and IT Educations reserves the right to adjust prices accordingly without prior notice.
Delays or unavailability of components due to suppliers, shipping, customs clearance, import regulations, or any external circumstances are beyond the control of IT Educations. The Client shall not hold IT Educations responsible for such delays.
IT Educations reserves the right to substitute components with equivalent or superior alternatives at its discretion, while ensuring functional compatibility with the project.

Ownership & Legal Terms

16. Ownership & Intellectual Property

Ownership of final deliverables transfers to the Client after full payment is made.
We may showcase the project in our portfolio unless confidentiality is requested in writing.

17. Code & File Handover

Source code, design files, or documentation will be shared only after full payment.
We reserve the right to obfuscate or withhold source unless agreed in scope.
Only 1 Synopsis, 1 PPT, and 1 Report (soft copy) will be provided; no further free changes will be accepted.
No free changes or modifications will be accepted after delivery of files to the client.

18. Confidentiality

All confidential information will be kept strictly confidential.
No client data will be shared with third parties without consent, except where required by law.

19. Compliance with Laws

The Client is responsible for ensuring legal compliance of their project.
We are not liable for misuse or unlawful applications of the delivered work.

20. Academic Use Disclaimer

All projects, materials, codes, and resources provided by IT Educations are intended strictly for educational and learning purposes only. They are not to be used for commercial, fraudulent, or any non-educational activities.
IT Educations makes no guarantees or warranties) regarding grades, marks, project acceptance, academic approval, or results obtained through the use of these projects. Any academic evaluation or outcome is solely the responsibility of the Client or student.
The Client acknowledges and agrees that any misuse, plagiarism, or unauthorized submission of the project will be the sole responsibility of the Client. IT Educations shall not be held liable for any academic, legal, or disciplinary consequences arising from such actions.

Dispute & Liability

21. Warranty & Liability

IT Educations expressly disclaims any and all warranties or guarantees, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement, for all hardware, software, deliverables, or services provided.
Upon delivery of the project, the Client acknowledges and agrees that IT Educations provides no warranty or guarantee with respect to the project, including but not limited to: functionality, correctness of code, performance, results, or suitability for any purpose.
IT Educations shall not be liable under any circumstances for any losses, damages, defects, failures, or malfunctions arising after project delivery, whether direct, indirect, incidental, consequential, or special, including but not limited to loss of data, revenue, profits, or business opportunities.
The Client shall be solely and fully responsible for the operation, maintenance, and use of the delivered project, including any modifications, integrations, or handling of hardware, software, or third-party components.
Any claims related to non-working code, software defects, hardware failure, data loss, or damages after project delivery shall be the sole responsibility of the Client. IT Educations shall have no obligation to repair, replace, or compensate for any such issues.

22. Limitation of Liability

Our liability is limited to the total amount paid by the Client.
We are not responsible for indirect damages such as lost revenue or reputational harm.

23. Indemnity

The Client agrees to indemnify and hold us harmless against any claims arising from misuse of the project or violation of laws.

24. Dispute Resolution

Disputes will first be attempted to be resolved through negotiation.
If unresolved, mediation or arbitration will apply before courts.

25. Governing Law

These terms are governed by the laws of Nagpur, India.
Jurisdiction lies with Nagpur courts.

Other Conditions

26. Non-Solicitation

The Client agrees not to directly hire or solicit our team for personal work during the project and 12 months after completion.

27. Force Majeure

We are not liable for delays due to events beyond our control (natural disasters, strikes, internet issues, pandemics).

28. Third-Party Dependencies

We are not responsible for downtime, discontinuation, or changes in third-party APIs, hosting, or services.

29. No Free Demos & Discontinuation Charges

No free demos will be provided for classes or projects.
If the Client discontinues after initiation, extra charges will apply.

30. Communication & Professional Conduc

All communications between IT Educations and the Client shall remain professional and respectful.
Abusive language, harassment, or any form of disrespectful behavior towards IT Educations or its team members will result in immediate project termination without any refund or liability.
Any attempt to defame IT Educations on social media, online reviews, or through public platforms without following the official dispute resolution process will be treated as defamation and may lead to legal action and monetary penalties.

31. Confidential Work & Non-Disclosure by Client

The Client shall not share, resell, reproduce, distribute, or publicly display any part of the project deliverables without written consent from IT Educations.
Any unauthorized disclosure, duplication, or redistribution of our proprietary materials (PPTs, reports, source code, project videos, or technical content) will attract legal consequences under Indian IT and IP laws.

32. Misuse, Fraud, or Academic Dishonesty

IT Educations does not endorse or support academic fraud, plagiarism, or fake submissions.
If the Client is found using the project in violation of institutional or legal regulations, IT Educations reserves the right to revoke usage rights, blacklist the Client, and report the misconduct to the concerned institution or authorities.

33. Communication Records

All communications related to the project (chat, email, calls, etc.) shall be considered official records.
In case of disputes, only written communication (email or registered chat) will be accepted as valid evidence.
Verbal discussions or phone calls hold no legal standing unless confirmed in writing.

34. Media Rights & Portfolio Usage

IT Educations reserves the right to record, document, or screenshot parts of the project for portfolio, promotional, or educational demonstration purposes unless the Client requests confidentiality in writing before project initiation.

35. Project Abandonment

A project shall be deemed abandoned if the Client fails to respond, pay, or provide necessary inputs for more than 30 consecutive days.
Abandoned projects will be automatically closed, and no refunds or further services will be provided.
Reactivation of an abandoned project will incur a restart fee of up to 25% of the total project cost.

36. Legal Action & Recovery

In cases of non-payment, breach of contract, defamation, or misuse of deliverables, IT Educations reserves the right to initiate civil and/or criminal proceedings under Indian Contract Act, 1872 and Information Technology Act, 2000.
All legal and collection expenses incurred for recovery will be borne entirely by the Client.

37. Client Feedback & Testimonial Usage

Any testimonials, feedback, or reviews voluntarily provided by the Client may be used by IT Educations for marketing and promotional purposes across its digital or printed platforms.
The Client may request removal of such content with a written notice if they wish to withdraw consent.

38. Quality Assurance Limitation

While IT Educations ensures that projects are functional and accurate as per the discussed scope, it does not guarantee:

100% bug-free performance,
Compatibility with all systems or devices, or
Institutional acceptance or grading outcomes.

All projects are delivered on an “as-is” basis for educational use only.

39. Digital Signatures & Electronic Agreement

Electronic acceptance of this document (by email, form submission, or payment) shall be considered legally equivalent to a signed physical agreement.
The Client’s digital acknowledgment shall serve as proof of consent and acceptance in all legal, administrative, and operational matters.

40. Data Backup & Cybersecurity Disclaimer

IT Educations is not responsible for data loss after final delivery. Clients must create and maintain their own backups of all deliverables.
We do not guarantee immunity from hacking, data breaches, or third-party attacks on delivered software or hardware.

41. Acceptance

Acknowledgment of Terms

By engaging, planning to engage, or receiving any service from IT Educations, including but not limited to project work, training, or guidance, the Client or Student hereby acknowledges that they have read, understood, and expressly agreed to be bound by all Terms and Conditions set forth by IT Educations.

Implied Consent

The commencement, continuation, or participation in any service provided by IT Educations shall constitute the Client’s or Student’s full and unconditional acceptance of these Terms and Conditions. The Client or Student further confirms that there are no doubts, objections, or reservations regarding any clause contained herein.

Waiver of Claims

Once a service has commenced, IT Educations shall not entertain any claims, disputes, or objections from the Client or Student on the grounds of unawareness, misinterpretation, or misunderstanding of these Terms and Conditions.

Once any service, project, or work is accepted or commenced, it shall be conclusively presumed that the Client or Student has been fully informed of, has read, and has unequivocally agreed to all Terms & Conditions of IT Educations. By initiating or continuing the service, the Client or Student is deemed to have expressly accepted all terms and conditions without exception. Failure to complete the official project registration form or provide required details at the time of service commencement shall be considered the sole responsibility and fault of the Client or Student, and IT Educations shall bear no liability for any resulting delays, issues, or disputes.

Right to Amend Terms

IT Educations reserves the absolute right, at its sole discretion, to modify, amend, update, or revise these Terms and Conditions, in whole or in part, at any time and under any circumstances, without prior notice or obligation to inform the Client or Student.

Continued Acceptance

Continued engagement or participation in any services provided by IT Educations following such modifications shall constitute the Client’s or Student’s binding acceptance of the revised Terms and Conditions in their entirety.

By proceeding with any service (project, training, or guidance), the Client or Student confirms acceptance of these Terms & Conditions in full.

🏛️ Legal Notes (as per Indian Law – Jurisdiction: Nagpur, Maharashtra, India)

These Terms and Conditions are framed in accordance with the provisions of the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable laws in force within the Republic of India.

All Clients and Students engaging with IT Educations acknowledge that they have carefully read, understood, and voluntarily agreed to these terms prior to initiating any transaction, service, or project. Such acceptance, whether by digital signature, electronic acknowledgment, checkbox consent, or email confirmation, shall constitute a legally binding agreement enforceable under Indian law.

Any dispute, claim, or difference arising out of or in connection with these terms—including payment obligations, service delivery, or project-related issues—shall be subject to the exclusive jurisdiction of the competent courts situated at Nagpur, Maharashtra (India). No legal proceedings shall be initiated in any other jurisdiction.

By proceeding with payment, project commencement, or service usage, the Client or Student hereby provides their irrevocable consent and acceptance to abide by all the terms, conditions, and policies set forth by IT Educations.

IT Educations reserves the right to modify, amend, or update these terms at any time without prior notice, and such revisions shall be binding upon all existing and future Clients or Students.

क्लाइंट नियम एवं शर्तें

सामान्य नियम

1. हमारी सेवाएँ

हम हार्डवेयर और सॉफ़्टवेयर परियोजनाओं के लिए परियोजना विकास, मार्गदर्शन और समर्थन प्रदान करते हैं, जैसा कि आपसी सहमति के अनुसार तय योजना में उल्लेखित है। परियोजना शुरू होने के चरण में, प्रारंभिक अनुमोदन के लिए 1 PPT और 1 सारांश (Synopsis) सामान्य रूप में प्रदान किया जाएगा। इसके बाद, कोई मुफ्त संशोधन स्वीकार नहीं किया जाएगा और क्लाइंट को अपने व्यक्तिगत और शैक्षणिक विवरण इन दस्तावेज़ों में शामिल करने होंगे। परियोजना अवधि के दौरान, क्लाइंट को नियमित अपडेट, प्रगति प्रदर्शन और विशेषज्ञ समर्थन प्राप्त होगा। परियोजना पूरा होने पर, क्लाइंट को पूर्ण परियोजना पैकेज मिलेगा जिसमें कार्यशील प्रोजेक्ट (हार्डवेयर/सॉफ़्टवेयर), स्रोत कोड और 1 बार रिपोर्ट (सॉफ्ट कॉपी) शामिल है। किसी भी अतिरिक्त कार्य या सहमति से बाहर बदलाव पर अतिरिक्त शुल्क लागू हो सकते हैं। शोध पत्र लेखन और प्रकाशन परियोजना लागत में **शामिल नहीं हैं**; यदि क्लाइंट को यह सेवा चाहिए, तो इसके लिए अलग से अनुरोध करना होगा और अतिरिक्त भुगतान करना होगा।

2. ग्राहक की जिम्मेदारियां

ग्राहक सभी आवश्यक प्रोजेक्ट विवरण, डेटा, दस्तावेज़ और सामग्री समय पर और पूरी तरह से प्रदान करेगा, जो प्रोजेक्ट या सेवा की सफलतापूर्वक पूर्णता के लिए अनिवार्य हैं। IT Educations किसी भी देरी, त्रुटि, या कमी के लिए जिम्मेदार नहीं होगा जो ग्राहक द्वारा अधूरी, गलत या देर से प्रस्तुतियों के कारण उत्पन्न होती है। ग्राहक यह भी स्वीकार करता है कि प्रोजेक्ट के लिए आवश्यक किसी भी सॉफ़्टवेयर लाइसेंस को IT Educations प्रदान नहीं करता है; सभी आवश्यक सॉफ़्टवेयर लाइसेंस की व्यवस्था और प्रदान करना ग्राहक या छात्र की पूरी जिम्मेदारी होगी।
ग्राहक को किसी भी अतिरिक्त आवश्यकताओं, संशोधनों या परिवर्तनों को कम से कम तीस (30) दिन पहले लिखित रूप में सूचित करना अनिवार्य है। इस अवधि के बाद प्राप्त अनुरोधों पर अतिरिक्त शुल्क और/या डिलीवरी में देरी लागू हो सकती है, जो केवल IT Educations के विवेक पर निर्भर होगी।
ग्राहक से अपेक्षा की जाती है कि वे IT Educations द्वारा भेजे गए सभी संचार, प्रश्न, स्पष्टीकरण और अनुमोदन अनुरोधों का तत्काल और पूर्ण उत्तर देंगे। ग्राहक द्वारा किसी भी विलंब, आंशिक उत्तर या गैर-उत्तर की स्थिति में होने वाली देरी पूरी तरह ग्राहक की जिम्मेदारी होगी, और इसके लिए IT Educations जिम्मेदार नहीं होगा।
ग्राहक यह सुनिश्चित करेगा कि सभी डेटा, सामग्री, दस्तावेज़ या कंटेंट सटीक, कानूनी और किसी भी कॉपीराइट, ट्रेडमार्क या बौद्धिक संपदा का उल्लंघन रहित हों। इस तरह की सामग्री के उपयोग से उत्पन्न किसी भी कानूनी परिणाम के लिए पूर्ण कानूनी जिम्मेदारी ग्राहक की होगी। IT Educations को किसी भी दावे, विवाद या कानूनी कार्रवाई के लिए जिम्मेदार नहीं ठहराया जा सकता।
ग्राहक को प्रोजेक्ट रजिस्ट्रेशन के समय आधिकारिक ऑनलाइन फॉर्म पूरा करना अनिवार्य है। ग्राहक या छात्र को रजिस्ट्रेशन फॉर्म पर प्रोजेक्ट विवरण / सार / उद्देश्य लिखित रूप में स्पष्ट रूप से बताना होगा। मौखिक संचार स्वीकार्य नहीं होगा। सभी कार्य केवल लिखित निर्देशों के अनुसार ही वैध माने जाएंगे। फॉर्म जमा करने के बाद किसी भी प्रकार की चर्चा, संशोधन या अनुरोध स्वीकार नहीं किया जाएगा। यदि ग्राहक बाद में ऐसा प्रयास करता है, तो IT Educations को अधिकार होगा कि वह प्रोजेक्ट तुरंत रोक दे या अतिरिक्त शुल्क वसूल करे।
केवल वही ग्राहक जो रजिस्ट्रेशन फॉर्म पूरा कर चुका है, प्रोजेक्ट से संबंधित IT Educations से संवाद करने का अधिकृत होगा। IT Educations किसी भी अनधिकृत व्यक्ति के साथ संवाद से इन्कार करेगा। किसी तीसरे पक्ष द्वारा संवाद पर जोर देने पर अतिरिक्त परामर्श शुल्क लगाया जा सकता है।
ग्राहक इस बात को स्वीकार करता है और सहमत है कि ऊपर बताई गई जिम्मेदारियों का पालन न करने की स्थिति में प्रोजेक्ट में देरी, कार्य रोकना, सेवाओं का समाप्त होना या अतिरिक्त शुल्क लागू हो सकते हैं, जिसके लिए IT Educations जिम्मेदार नहीं होगा। सभी परिणामों की पूर्ण जिम्मेदारी ग्राहक की होगी।

3. क्लाइंट की स्वीकृति और सहमति

हमारी सेवाओं (परियोजनाएँ, प्रशिक्षण, मार्गदर्शन) का लाभ लेने से, क्लाइंट पुष्टि करता है कि उसने सभी नियम और शर्तों को पढ़ लिया है और समझ लिया है।
सेवा शुरू होने के बाद किसी भी अज्ञानता या गलतफहमी का दावा स्वीकार नहीं किया जाएगा।

प्रोजेक्ट शुरू करने से पहले न्यूनतम 50% अग्रिम भुगतान अनिवार्य है।
शेष 50% भुगतान प्रोजेक्ट पूरा होने और अंतिम डिलीवरी या हैंडओवर से पहले तुरंत किया जाना चाहिए।

सॉफ़्टवेयर प्रोजेक्ट्स:

प्रोजेक्ट शुरू करने से पहले 30% अग्रिम भुगतान अनिवार्य है।
पहले माइलस्टोन या आंशिक डिलीवरी के पूरा होने पर 30% भुगतान किया जाना चाहिए।
अंतिम प्रोजेक्ट डिलीवरी के समय शेष 40% भुगतान किया जाना चाहिए।

सामान्य भुगतान नियम:

सभी भुगतान उपरोक्त अनुसूची के अनुसार होने चाहिए जब तक कि IT Educations द्वारा लिखित रूप में अन्यथा सहमति न हो।
यदि ग्राहक कुल भुगतान को तीन (3) से अधिक किस्तों में बांटने का अनुरोध करता है, तो ऐसे भुगतान पर अतिरिक्त प्रशासनिक शुल्क या दंड लागू होगा और प्रोजेक्ट की विकास या डिलीवरी समयसीमा में देरी हो सकती है।
अनुमोदित अनुसूची से अधिक भुगतान में देरी होने पर, चल रहे कार्य को तब तक स्थगित किया जा सकता है जब तक सभी बकाया राशि पूर्ण रूप से न चुका दी जाए।
सभी भुगतान IT Educations द्वारा निर्दिष्ट आधिकारिक भुगतान विधियों (UPI, बैंक ट्रांसफर आदि) के माध्यम से किए जाने चाहिए।
यदि ग्राहक या छात्र 70% से 80% तक का प्रोजेक्ट कार्य (जिसमें आंशिक डिलीवरी, डेमो या कोड एक्सेस शामिल है) प्राप्त करना चाहते हैं, तो उन्हें बिना किसी तर्क या आपत्ति के 100% कुल भुगतान अग्रिम में करना होगा।

महत्वपूर्ण:

सभी भुगतान किसी भी परिस्थिति में गैर-वापसी योग्य और गैर-संशोधित हैं।
विलंबित भुगतान परियोजना में देरी या अतिरिक्त शुल्क उत्पन्न कर सकते हैं।

5. गैर-वापसी योग्य भुगतान (Non-Refundable Payments)

IT Educations या इस फर्म के स्वामी को किया गया कोई भी भुगतान किसी भी परिस्थिति में गैर-वापसी योग्य और गैर-हस्तांतरणीय होगा, चाहे प्रोजेक्ट की स्थिति, प्रगति, डिलीवरी चरण या ग्राहक की संतुष्टि का स्तर कुछ भी हो।
एक बार भुगतान हो जाने के बाद, वह अंतिम और बाध्यकारी माना जाएगा और उसे किसी भी स्थिति में संशोधित, रद्द, समायोजित या भविष्य के किसी प्रोजेक्ट, सेवा या खाते में क्रेडिट नहीं किया जा सकेगा।
नियम एवं शर्तें (Terms & Conditions) का लिंक हमारे UPI और अन्य भुगतान पृष्ठों पर स्पष्ट रूप से प्रदर्शित किया जाएगा। भुगतान करने से पहले इन शर्तों को पढ़ना और समझना ग्राहक की स्वयं की जिम्मेदारी है।
यदि ग्राहक नियम एवं शर्तें पढ़े बिना भुगतान करता है, तो यह माना जाएगा कि उसने स्वेच्छा से सभी शर्तों को स्वीकार कर लिया है। भुगतान पूर्ण होने के बाद किसी भी प्रकार का विवाद, रिफंड अनुरोध या तर्क अमान्य और अस्वीकार्य माना जाएगा।
भुगतान शुरू करते समय, ग्राहक इन सभी शर्तों से सहमत होता है और भुगतान या रिफंड से संबंधित किसी भी दावे, चार्जबैक या कानूनी आपत्ति का अधिकार छोड़ देता है।

6. तात्कालिक परियोजना शुल्क

1 से 10 दिनों में पूर्ण करने वाली परियोजनाएँ तात्कालिक मानी जाएँगी।
तात्कालिक परियोजनाओं पर डबल शुल्क लगेगा।
कंपनी उपलब्धता के आधार पर तात्कालिक परियोजना अस्वीकार कर सकती है।

परियोजना कार्यप्रवाह

7. परियोजना डिलीवरी

अनुमानित डिलीवरी समय परियोजना योजना में साझा किया जाएगा।
क्लाइंट के विलंब या अधूरी जानकारी से समय पर प्रभाव पड़ेगा।
अप्रत्याशित तकनीकी समस्याओं या प्राकृतिक आपदाओं से भी डिलीवरी प्रभावित हो सकती है।
प्रोजेक्ट रिपोर्ट / थीसिस डिलीवरी: अंतिम प्रोजेक्ट डिलीवरी के बाद 3–15 दिनों के भीतर प्रोजेक्ट रिपोर्ट या थीसिस की सॉफ्ट कॉपी प्रदान की जाएगी। रिपोर्ट / थीसिस सामान्य प्रारूप में होगी और 20–30 पृष्ठों तक सीमित होगी। इस सीमा से अधिक किसी भी कस्टमाइज़ेशन, अतिरिक्त सामग्री या विशेष फॉर्मेटिंग के लिए अतिरिक्त शुल्क लिया जाएगा। ₹10,000/- से अधिक मूल्य वाले प्रोजेक्ट्स (हार्डवेयर प्रोजेक्ट्स के मामले में हार्डवेयर मूल्य को छोड़कर) के लिए ही मुफ़्त सॉफ्ट कॉपी दी जाएगी; इससे कम मूल्य वाले प्रोजेक्ट्स के लिए प्रोजेक्ट रिपोर्ट / थीसिस का शुल्क लिया जाएगा।

8. संशोधन

मिनर फिक्स और सामान्य संशोधन शामिल हैं।
मुख्य बदलावों के लिए अतिरिक्त शुल्क लागू होगा।
समीक्षा अवधि के भीतर ही संशोधन अनुरोध किया जा सकता है।

9. परियोजना स्कोप फ्रीज़

एक बार परियोजना स्कोप फाइनल हो जाने के बाद, कोई मुख्य बदलाव बिना पुनः चर्चा के स्वीकार नहीं होंगे।
कोई भी बड़ा बदलाव करने पर स्कोप संशोधन दस्तावेज़ और अतिरिक्त लागत लागू होगी।

10. क्लाइंट-प्रेरित विराम

यदि क्लाइंट 14 दिनों से अधिक परियोजना रोकता है, तो पुनः शुरू करने का शुल्क लागू हो सकता है।
30 दिनों से अधिक निष्क्रियता होने पर परियोजना परित्यक्त मानी जाएगी और कोई रिफंड नहीं दिया जाएगा।

11. डिलीवरी के बाद की ज़िम्मेदारी और प्रोजेक्ट संग्रह

प्रोजेक्ट डिलीवरी के बाद उत्पन्न किसी भी समस्या (त्रुटि, डेटा हानि, हार्डवेयर/सॉफ्टवेयर की क्षति आदि) के लिए IT Educations किसी भी स्थिति में ज़िम्मेदार नहीं होगा।
सभी प्रोजेक्ट डेटा, सामग्री और संसाधन केवल शैक्षणिक एवं शैक्षिक उपयोग के लिए प्रदान किए जाते हैं। किसी भी प्रकार के व्यावसायिक, अनैतिक या गैर-शैक्षणिक उपयोग के लिए पूर्ण ज़िम्मेदारी ग्राहक की होगी।
प्रोजेक्ट या उसके किसी भी भाग के दुरुपयोग या अनधिकृत उपयोग से उत्पन्न किसी भी कानूनी, तकनीकी या वित्तीय परिणामों के लिए IT Educations उत्तरदायी नहीं होगा।
ग्राहक को प्रोजेक्ट पूरा होते ही तुरंत संग्रह करना आवश्यक है। विलंबित संग्रह के लिए अतिरिक्त भंडारण या हैंडलिंग शुल्क लिया जा सकता है।

संचार और समर्थन

12. संचार और कार्यालय समय

उत्तर देने का समय 24–48 कार्य दिवस है। तत्काल उत्तर की गारंटी नहीं।
सप्ताहांत और सार्वजनिक छुट्टियाँ शामिल नहीं।
ऑफ-डे कॉल या संदेश पर ₹1000 जुर्माना लागू होगा।

13. सपोर्ट एवं मेंटेनेंस (डिलीवरी के बाद)

एक बार प्रोजेक्ट की डिलीवरी और स्वीकृति हो जाने के बाद, IT Educations किसी भी प्रकार का मुफ्त सपोर्ट, अपडेट या मॉडिफिकेशन देने के लिए बाध्य नहीं होगा, जब तक कि यह स्पष्ट रूप से प्रोजेक्ट स्कोप या दस्तावेज़ में उल्लेखित न हो।
डिलीवरी के बाद किसी भी प्रकार की तकनीकी सहायता, समस्या समाधान, बग फिक्सिंग, मेंटेनेंस या फीचर सुधार की मांग को सशुल्क सेवा माना जाएगा और इसके लिए IT Educations की वर्तमान दरों के अनुसार शुल्क लिया जाएगा।
डिलीवरी के बाद ग्राहक द्वारा किए गए किसी भी बदलाव, तृतीय-पक्ष सॉफ़्टवेयर, हार्डवेयर अपग्रेड या सिस्टम परिवर्तन के कारण उत्पन्न समस्याओं के लिए IT Educations जिम्मेदार नहीं होगा।
ग्राहक को अंतिम स्वीकृति से पहले प्रोजेक्ट की सभी कार्यक्षमताओं की पूरी तरह जांच और अनुमोदन करना आवश्यक है, क्योंकि डिलीवरी के बाद किए जाने वाले किसी भी बदलाव या पुन:कार्य के लिए अतिरिक्त शुल्क लिया जाएगा।

हार्डवेयर और तकनीकी शर्तें

14. हार्डवेयर क्षति और प्रतिस्थापन

ग्राहक या छात्र किसी भी हार्डवेयर क्षति, खराबी, जलने या गैर-कार्यशीलता के लिए पूर्ण और एकमात्र जिम्मेदार होगा, चाहे वह प्रोजेक्ट कार्य के दौरान ही क्यों न हो। इस तरह की किसी भी क्षति की मरम्मत या प्रतिस्थापन की सभी लागत ग्राहक को वहन करनी होगी, किसी भी परिस्थिति में।
IT Educations किसी भी परिस्थिति में किसी भी क्षति के लिए जिम्मेदार नहीं होगा, जो गलत उपयोग, अनुचित हैंडलिंग, गलत इंस्टॉलेशन, शॉर्ट सर्किट, वोल्टेज उतार-चढ़ाव, बाहरी पर्यावरणीय कारक, या हमारे नियंत्रण से बाहर किसी भी कारण से हुई हो।
IT Educations द्वारा किया गया कोई भी प्रतिस्थापन, मरम्मत, या सेवा वर्तमान बाजार दरों पर ग्राहक से वसूली जाएगी। IT Educations को प्रतिस्थापन का तरीका, विक्रेता या सेवा प्रदाता चुनने का पूर्ण अधिकार होगा, और ग्राहक द्वारा सुझाए गए विकल्पों के लिए कोई जिम्मेदारी नहीं होगी।
ग्राहक स्वीकार करता है और सहमत है कि भले ही हार्डवेयर की क्षति प्रोजेक्ट कार्य के दौरान हुई हो, यह पूरी तरह ग्राहक की जिम्मेदारी होगी और IT Educations ऐसी घटनाओं के लिए किसी भी वित्तीय, कानूनी, या संचालनात्मक जिम्मेदारी का सामना नहीं करेगा।

15. घटक उपलब्धता और मूल्य निर्धारण

सभी हार्डवेयर कीमतें बाजार के अनुसार बदल सकती हैं।
क्लाइंट इन परिवर्तनों के लिए जिम्मेदार नहीं ठहरा सकता।
IT Educations समान या बेहतर घटक का विकल्प चुन सकता है।

स्वामित्व और कानूनी शर्तें

16. स्वामित्व और बौद्धिक संपदा

पूर्ण भुगतान के बाद अंतिम उत्पाद का स्वामित्व क्लाइंट को हस्तांतरित होगा।
हम परियोजना को अपने पोर्टफोलियो में प्रदर्शित कर सकते हैं, जब तक कि गोपनीयता लिखित रूप में न मांगी जाए।

17. कोड और फ़ाइल हस्तांतरण

स्रोत कोड, डिजाइन फाइल या दस्तावेज़ केवल पूर्ण भुगतान के बाद साझा किए जाएंगे।
हस्तांतरण के बाद कोई मुफ्त संशोधन नहीं होगा।

18. गोपनीयता

सभी गोपनीय जानकारी गोपनीय रखी जाएगी।
कानून द्वारा आवश्यकता होने पर ही डेटा साझा किया जाएगा।

19. कानून का पालन

क्लाइंट अपनी परियोजना की कानूनी जिम्मेदारी का पालन करेगा।
अवैध उपयोग के लिए हम जिम्मेदार नहीं हैं।

20. शैक्षणिक उपयोग अस्वीकरण

IT Educations द्वारा प्रदान किए गए सभी प्रोजेक्ट, सामग्री, कोड और संसाधन केवल शैक्षणिक और सीखने के उद्देश्यों के लिए हैं। इन्हें किसी भी वाणिज्यिक, धोखाधड़ी या गैर-शैक्षणिक गतिविधियों में उपयोग नहीं किया जाना चाहिए।
IT Educations किसी भी प्रकार की ग्रेड, अंक, प्रोजेक्ट स्वीकृति, शैक्षणिक मंजूरी या परिणाम की गारंटी या वॉरंटी नहीं देता। प्रोजेक्ट के उपयोग से प्राप्त किसी भी शैक्षणिक मूल्यांकन या परिणाम की जिम्मेदारी पूरी तरह से ग्राहक या छात्र की होगी।
ग्राहक यह स्वीकार करता है और सहमत है कि किसी भी प्रकार के दुरुपयोग, साहित्यिक चोरी (प्लेज़रिज़्म), या अनधिकृत सबमिशन के परिणामस्वरूप होने वाली किसी भी शैक्षणिक, कानूनी या अनुशासनात्मक कार्रवाई की पूर्ण जिम्मेदारी ग्राहक की होगी। IT Educations ऐसी घटनाओं के लिए किसी भी जिम्मेदारी से मुक्त रहेगा।

विवाद और दायित्व

21. वारंटी और दायित्व

IT Educations किसी भी वारंटी या गारंटी से इनकार करता है।
डिलीवरी के बाद किसी भी नुकसान या त्रुटि के लिए हम जिम्मेदार नहीं होंगे।

22. दायित्व की सीमा

हमारा दायित्व केवल क्लाइंट द्वारा भुगतान की गई राशि तक सीमित है।
हम अप्रत्यक्ष नुकसान के लिए जिम्मेदार नहीं हैं।

23. क्षतिपूर्ति

क्लाइंट किसी भी दावे से हमें बचाएगा जो परियोजना के दुरुपयोग या कानून उल्लंघन से उत्पन्न हो।

24. विवाद समाधान

विवाद पहले बातचीत के माध्यम से सुलझाए जाएंगे।
असफल होने पर मध्यस्थता या अदालत का रास्ता अपनाया जाएगा।

25. लागू कानून

ये नियम नागपुर, भारत के कानूनों द्वारा संचालित होंगे।
नागपुर की अदालतों का क्षेत्राधिकार है।

अन्य शर्तें

26. गैर-भर्ती

क्लाइंट सहमत है कि परियोजना के दौरान या 12 महीनों तक हमारी टीम को व्यक्तिगत काम के लिए नहीं भर्ती करेगा।

27. फोर्स मेज़र

हम उन घटनाओं के कारण होने वाली देरी के लिए उत्तरदायी नहीं हैं जो हमारे नियंत्रण से बाहर हैं (प्राकृतिक आपदाएँ, हड़तालें, इंटरनेट समस्याएँ, महामारी)।

28. तृतीय-पक्ष निर्भरताएँ

हम तीसरे पक्ष के APIs, होस्टिंग, या सेवाओं में डाउनटाइम, बंदी, या बदलाव के लिए उत्तरदायी नहीं हैं।

29. मुफ्त डेमो और बंदी शुल्क नहीं

कक्षाओं या प्रोजेक्ट्स के लिए कोई मुफ्त डेमो प्रदान नहीं किया जाएगा।
यदि क्लाइंट प्रोजेक्ट शुरू होने के बाद सेवा रोकता है, तो अतिरिक्त शुल्क लागू होंगे।

30. संचार और व्यावसायिक आचरण

आईटी एज्युकेशन्स और क्लाइंट के बीच सभी संचार पेशेवर और सम्मानजनक होने चाहिए।
आईटी एज्युकेशन्स या उसके टीम सदस्यों के प्रति किसी भी प्रकार की अपमानजनक भाषा, उत्पीड़न या असम्मानजनक व्यवहार होने पर प्रोजेक्ट तुरंत समाप्त कर दिया जाएगा और कोई धनवापसी या जिम्मेदारी नहीं होगी।
बिना आधिकारिक विवाद समाधान प्रक्रिया अपनाए आईटी एज्युकेशन्स की सोशल मीडिया, ऑनलाइन रिव्यू या सार्वजनिक मंचों पर बदनामी करने का कोई भी प्रयास मानहानि माना जाएगा और उस पर कानूनी कार्रवाई एवं आर्थिक दंड लगाया जा सकता है।

31. गोपनीय कार्य एवं गैर-प्रकटीकरण

क्लाइंट आईटी एज्युकेशन्स की लिखित अनुमति के बिना किसी भी प्रोजेक्ट डिलिवरेबल्स को साझा, पुनर्विक्रय, पुनरुत्पादन, वितरित या सार्वजनिक रूप से प्रदर्शित नहीं करेगा।
हमारी स्वामित्व वाली सामग्रियों (PPT, रिपोर्ट, सोर्स कोड, प्रोजेक्ट वीडियो या तकनीकी सामग्री) के किसी भी अनधिकृत उपयोग या वितरण पर भारतीय आईटी और आईपी कानूनों के तहत कानूनी कार्रवाई की जाएगी।

32. दुरुपयोग, धोखाधड़ी या अकादमिक बेईमानी

आईटी एज्युकेशन्स किसी भी प्रकार की अकादमिक धोखाधड़ी, साहित्यिक चोरी या फर्जी सबमिशन का समर्थन नहीं करता।
यदि क्लाइंट प्रोजेक्ट का उपयोग संस्थागत या कानूनी नियमों का उल्लंघन करते हुए करता है, तो आईटी एज्युकेशन्स उपयोग अधिकार रद्द करने, क्लाइंट को ब्लैकलिस्ट करने और संबंधित संस्था या प्राधिकरण को रिपोर्ट करने का अधिकार रखता है।

33. संचार अभिलेख

प्रोजेक्ट से संबंधित सभी संचार (चैट, ईमेल, कॉल आदि) आधिकारिक अभिलेख माने जाएंगे।
किसी भी विवाद की स्थिति में केवल लिखित संचार (ईमेल या आधिकारिक चैट) को वैध प्रमाण माना जाएगा।
मौखिक चर्चा या फोन कॉल को तब तक मान्य नहीं माना जाएगा जब तक वह लिखित रूप में पुष्टि न की जाए।

34. मीडिया अधिकार और पोर्टफोलियो उपयोग

आईटी एज्युकेशन्स को अपने पोर्टफोलियो, प्रचार या शैक्षणिक प्रदर्शन के लिए प्रोजेक्ट के कुछ भागों का दस्तावेज़ीकरण, स्क्रीनशॉट या रिकॉर्डिंग करने का अधिकार है, जब तक कि क्लाइंट गोपनीयता के लिए लिखित अनुरोध न करे।

35. प्रोजेक्ट परित्याग

यदि क्लाइंट 30 लगातार दिनों तक उत्तर, भुगतान या आवश्यक जानकारी नहीं देता है, तो प्रोजेक्ट को परित्यक्त माना जाएगा।
परित्यक्त प्रोजेक्ट स्वतः बंद कर दिए जाएंगे, और कोई धनवापसी या सेवा उपलब्ध नहीं होगी।
परित्यक्त प्रोजेक्ट को पुनः सक्रिय करने पर कुल प्रोजेक्ट लागत का 25% तक पुनः प्रारंभ शुल्क लगेगा।

36. कानूनी कार्रवाई और वसूली

भुगतान न करने, अनुबंध के उल्लंघन, मानहानि या डिलिवरेबल्स के दुरुपयोग की स्थिति में आईटी एज्युकेशन्स भारतीय अनुबंध अधिनियम 1872 और सूचना प्रौद्योगिकी अधिनियम 2000 के तहत नागरिक या आपराधिक कार्रवाई कर सकता है।
वसूली हेतु किए गए सभी कानूनी या अन्य खर्च क्लाइंट को वहन करने होंगे।

37. क्लाइंट फीडबैक और प्रशंसापत्र उपयोग

क्लाइंट द्वारा स्वेच्छा से प्रदान की गई कोई भी प्रतिक्रिया या प्रशंसापत्र आईटी एज्युकेशन्स के विपणन और प्रचार उद्देश्यों के लिए उपयोग किया जा सकता है।
क्लाइंट लिखित अनुरोध देकर इस सामग्री को हटाने का अनुरोध कर सकता है।

38. गुणवत्ता आश्वासन की सीमाएँ

आईटी एज्युकेशन्स यह सुनिश्चित करता है कि प्रोजेक्ट सहमति अनुसार कार्यात्मक और सटीक हो, लेकिन यह गारंटी नहीं देता कि:

प्रोजेक्ट 100% बग-फ्री होगा,
सभी सिस्टम या उपकरणों के साथ संगत होगा, या
संस्थान द्वारा स्वीकार या उच्च ग्रेड प्रदान किए जाएंगे।

सभी प्रोजेक्ट केवल शैक्षणिक उपयोग के लिए "जैसा है" आधार पर दिए जाते हैं।

39. डिजिटल हस्ताक्षर और इलेक्ट्रॉनिक अनुबंध

ईमेल, फॉर्म सबमिशन या भुगतान द्वारा इस दस्तावेज़ की स्वीकृति को भौतिक हस्ताक्षर के समान कानूनी मान्यता प्राप्त होगी।
क्लाइंट की डिजिटल स्वीकृति सभी कानूनी, प्रशासनिक और संचालन संबंधी मामलों में सहमति का प्रमाण मानी जाएगी।

40. डेटा बैकअप और साइबर सुरक्षा अस्वीकरण

अंतिम डिलिवरी के बाद आईटी एज्युकेशन्स डेटा हानि के लिए जिम्मेदार नहीं है। क्लाइंट को सभी डिलिवरेबल्स का बैकअप स्वयं रखना होगा।
हम किसी भी प्रकार की हैकिंग, डेटा चोरी या थर्ड पार्टी हमलों से सुरक्षा की गारंटी नहीं देते।

41. स्वीकृति (Acceptance)

नियमों की स्वीकृति

IT Educations से किसी भी प्रकार की सेवा (जैसे प्रोजेक्ट कार्य, प्रशिक्षण या मार्गदर्शन) प्राप्त करने, प्राप्त करने की योजना बनाने या उसमें भाग लेने से पहले, ग्राहक या छात्र यह स्वीकार करता/करती है कि उसने इन सभी नियमों और शर्तों को पढ़ा, समझा और इनसे सहमति व्यक्त की है।

निहित सहमति

IT Educations द्वारा प्रदान की जाने वाली किसी भी सेवा की शुरुआत, निरंतरता या भागीदारी ग्राहक या छात्र की इन नियमों और शर्तों के प्रति पूर्ण और बिना शर्त स्वीकृति मानी जाएगी। ग्राहक या छात्र पुष्टि करता/करती है कि उसे किसी भी खंड के प्रति कोई संदेह, आपत्ति या आरक्षण नहीं है।

दावे से छूट

एक बार सेवा प्रारंभ हो जाने के बाद, IT Educations किसी भी ग्राहक या छात्र के दावे, विवाद या आपत्तियों को यह कहते हुए स्वीकार नहीं करेगा कि उसने इन नियमों और शर्तों को नहीं समझा या गलत समझा।

किसी भी सेवा, प्रोजेक्ट या कार्य की स्वीकृति या शुरुआत के बाद यह माना जाएगा कि ग्राहक या छात्र ने सभी नियमों और शर्तों को पूरी तरह से पढ़ लिया है, समझ लिया है और उनसे स्पष्ट रूप से सहमति व्यक्त की है। यदि सेवा के आरंभ में आवश्यक जानकारी या रजिस्ट्रेशन फॉर्म पूरा नहीं किया गया है, तो उसकी पूरी जिम्मेदारी ग्राहक या छात्र की होगी और इसके परिणामस्वरूप उत्पन्न किसी भी देरी, समस्या या विवाद के लिए IT Educations जिम्मेदार नहीं होगा।

नियमों में संशोधन का अधिकार

IT Educations को यह पूर्ण अधिकार है कि वह अपनी इच्छा से किसी भी समय, बिना पूर्व सूचना दिए, इन नियमों और शर्तों को संशोधित, अद्यतन या परिवर्तित कर सकता है।

निरंतर स्वीकृति

IT Educations द्वारा प्रदान की जाने वाली सेवाओं में निरंतर भागीदारी या संलग्नता इन संशोधित नियमों और शर्तों की पूर्ण और बाध्यकारी स्वीकृति मानी जाएगी।

किसी भी सेवा (प्रोजेक्ट, प्रशिक्षण या मार्गदर्शन) को आगे बढ़ाने से ग्राहक या छात्र यह पुष्टि करता/करती है कि उसने इन सभी नियमों और शर्तों को पूरी तरह स्वीकार किया है।

🏛️ कानूनी नोट (भारतीय कानून के अनुसार – अधिकार क्षेत्र: नागपुर, महाराष्ट्र, भारत)

ये नियम और शर्तें भारतीय अनुबंध अधिनियम, 1872 और सूचना प्रौद्योगिकी अधिनियम, 2000 के प्रावधानों के अनुरूप हैं और भारत गणराज्य के वर्तमान लागू कानूनों के अनुसार तैयार की गई हैं।

IT Educations से जुड़ने वाले सभी ग्राहक और छात्र यह स्वीकार करते हैं कि उन्होंने किसी भी लेनदेन, सेवा या प्रोजेक्ट की शुरुआत से पहले इन नियमों को ध्यानपूर्वक पढ़ा, समझा और स्वेच्छा से स्वीकार किया है। यह स्वीकृति डिजिटल हस्ताक्षर, इलेक्ट्रॉनिक पुष्टि, चेकबॉक्स सहमति या ईमेल पुष्टि के माध्यम से कानूनी रूप से बाध्यकारी मानी जाएगी।

इन नियमों से संबंधित किसी भी भुगतान, सेवा वितरण या प्रोजेक्ट से उत्पन्न विवाद का निपटारा केवल नागपुर, महाराष्ट्र (भारत) स्थित सक्षम न्यायालयों के अधिकार क्षेत्र में होगा। किसी अन्य क्षेत्र में कोई कानूनी कार्यवाही प्रारंभ नहीं की जाएगी।

भुगतान करने, प्रोजेक्ट शुरू करने या सेवा का उपयोग करने पर ग्राहक या छात्र यह अपरिवर्तनीय सहमति देता/देती है कि वह IT Educations द्वारा निर्धारित सभी नियमों और नीतियों का पालन करेगा/करेगी।

IT Educations को बिना पूर्व सूचना के किसी भी समय इन नियमों को संशोधित या अपडेट करने का अधिकार है, और ऐसे सभी संशोधन मौजूदा और भविष्य के सभी ग्राहकों एवं छात्रों पर बाध्यकारी होंगे।

सामान्य नियम

1. आमच्या सेवा

आम्ही प्रोजेक्ट डेव्हलपमेंट, मार्गदर्शन आणि हार्डवेअर व सॉफ्टवेअर प्रोजेक्टसाठी समर्थन पुरवतो, जे परस्पर मान्य केलेल्या योजनेनुसार असते. प्रोजेक्ट सुरूवातीच्या टप्प्यात, प्राथमिक मंजुरीसाठी 1 PPT आणि 1 संक्षिप्त स्वरूपातील Synopsis दिले जाईल. त्यानंतर कोणत्याही विनामूल्य बदलाची परवानगी मिळणार नाही, आणि क्लायंटने त्यांच्या संस्था मागितल्याप्रमाणे वैयक्तिक आणि शैक्षणिक माहिती त्या दस्तऐवजांमध्ये समाविष्ट करणे आवश्यक आहे. प्रोजेक्ट कालावधीत, क्लायंटला नियमित अद्यतने, प्रगतीचे प्रदर्शन आणि शंका/संदेहांसाठी तज्ज्ञ समर्थन मिळेल. वितरणाच्या वेळी, क्लायंटला संपूर्ण प्रोजेक्ट पॅकेज प्राप्त होईल ज्यात कार्यरत प्रोजेक्ट (हार्डवेअर/सॉफ्टवेअर), स्रोत कोड, आणि 1 वेळेचा रिपोर्ट (सॉफ्ट कॉपी) समाविष्ट असेल. मान्य केलेल्या कार्यक्षेत्राबाहेरील अतिरिक्त काम किंवा बदलांसाठी अतिरिक्त शुल्क लागू होऊ शकते. संशोधन पेपर लेखन आणि प्रकाशन प्रोजेक्ट खर्चात **समाविष्ट नाही**; या सेवेसाठी क्लायंटने स्वतंत्रपणे विनंती करणे आवश्यक आहे व अतिरिक्त पैसे देणे आवश्यक आहे.

2. ग्राहकाची जबाबदाऱ्या

ग्राहक सर्व आवश्यक प्रोजेक्ट तपशील, डेटा, दस्तऐवज आणि साहित्य वेळेत आणि पूर्णपणे प्रदान करेल, जे प्रोजेक्ट किंवा सेवेस यशस्वीरीत्या पूर्ण करण्यासाठी अत्यावश्यक आहेत. IT Educations त्या कोणत्याही विलंब, त्रुटी किंवा अपूर्णतेसाठी जबाबदार राहणार नाही जे ग्राहकाकडून अपूर्ण, अचूक नसलेल्या किंवा उशिरा सादर केलेल्या सामग्रीमुळे उद्भवतात. ग्राहक हे देखील मान्य करतो की प्रोजेक्टसाठी आवश्यक कोणतेही सॉफ्टवेअर लायसन्स IT Educations प्रदान करत नाही; सर्व आवश्यक सॉफ्टवेअर लायसन्सची सोय आणि प्रदान करणे ग्राहक किंवा विद्यार्थ्याची पूर्ण जबाबदारी असेल.
ग्राहकाने कोणत्याही अतिरिक्त आवश्यकतांचा, बदलांचा किंवा सुधारणा करण्याचा इरादा किमान तीस (30) दिवस आधी लिखित स्वरूपात कळवणे आवश्यक आहे. या कालावधीनंतर प्राप्त होणाऱ्या विनंत्यांवर अतिरिक्त शुल्क आणि/किंवा डिलिव्हरी उशीर लागू होऊ शकतो, जे फक्त IT Educations च्या विवेकावर अवलंबून असेल.
ग्राहकाने IT Educations कडून केलेल्या सर्व संपर्क, प्रश्न, स्पष्टीकरणे आणि मंजुरीच्या विनंत्यांना त्वरित आणि पूर्ण प्रतिसाद देणे आवश्यक आहे. ग्राहकाकडून विलंब, आंशिक प्रतिसाद किंवा प्रतिसाद न देणे यामुळे होणारा प्रोजेक्ट उशीर पूर्णपणे ग्राहकाची जबाबदारी असेल, आणि यासाठी IT Educations जबाबदार राहणार नाही.
ग्राहकाने सुनिश्चित करावे की सर्व डेटा, साहित्य, दस्तऐवज किंवा सामग्री अचूक, कायदेशीर आणि कोणत्याही कॉपीराइट, ट्रेडमार्क किंवा बौद्धिक संपदा हक्कांचा भंग नसलेली असावी. अशा सामग्रीच्या वापरामुळे निर्माण होणाऱ्या कोणत्याही कायदेशीर परिणामांची पूर्ण जबाबदारी ग्राहकाची असेल. IT Educations कोणत्याही दावे, वाद किंवा कायदेशीर कारवाईसाठी जबाबदार राहणार नाही.
ग्राहकाने प्रोजेक्ट रजिस्ट्रेशन करताना अधिकृत ऑनलाइन फॉर्म पूर्ण करणे अनिवार्य आहे. ग्राहक किंवा विद्यार्थी रजिस्ट्रेशन फॉर्मवर प्रोजेक्टचे वर्णन / सार / उद्देश लिखित स्वरूपात स्पष्ट करणे आवश्यक आहे. मौखिक संवाद स्वीकारला जाणार नाही. सर्व कार्य फक्त लिखित निर्देशांनुसार वैध मानले जातील. फॉर्म सादर केल्यानंतर कोणतीही चर्चा, सुधारणा किंवा विनंती मान्य केली जाणार नाही. जर ग्राहक नंतर असे करण्याचा प्रयत्न करतो, तर IT Educations ला अधिकार असेल की तो प्रोजेक्ट ताबडतोब थांबवेल किंवा अतिरिक्त शुल्क आकारेल.
फक्त तो ग्राहक ज्याने रजिस्ट्रेशन फॉर्म पूर्ण केला आहे, प्रोजेक्टसंबंधी IT Educations शी संवाद साधण्याचा अधिकृत असेल. IT Educations कोणत्याही अनधिकृत व्यक्तीशी संवाद करण्यास नकार देईल. कोणत्याही तृतीय पक्षाद्वारे संवादावर दबाव टाकल्यास अतिरिक्त सल्ला शुल्क आकारले जाऊ शकते.
ग्राहक हे मान्य करतो आणि सहमत आहे की वर नमूद केलेल्या जबाबदाऱ्यांचे पालन न केल्यास प्रोजेक्टमध्ये उशीर, कार्याचा थांबवणे, सेवा समाप्त करणे किंवा अतिरिक्त शुल्क लागू होऊ शकतात, ज्यासाठी IT Educations जबाबदार राहणार नाही. सर्व परिणामांची पूर्ण जबाबदारी ग्राहकाची असेल.

3. क्लायंटची मान्यता व सहमती

आमच्या सेवा (प्रोजेक्ट, प्रशिक्षण, मार्गदर्शन) घेतल्यास, क्लायंट पुष्टी करतो की त्यांनी सर्व नियम व अटी वाचल्या, समजल्या आणि सहमती दिली आहे.
एकदा सेवा सुरू झाल्यानंतर अज्ञानतेचे किंवा गैरसमजुतीचे दावे मान्य केले जाणार नाहीत.

पेमेंट्स व शुल्क

4. ⚡ पेमेंट्स ⚡

हार्डवेअर प्रोजेक्ट्स:

प्रोजेक्ट सुरू करण्यापूर्वी किमान 50% आगाऊ पेमेंट करणे अनिवार्य आहे.
शिल्लक 50% पेमेंट प्रोजेक्ट पूर्ण झाल्यानंतर आणि अंतिम डिलिव्हरी किंवा हँडओव्हरपूर्वी तत्काळ करणे आवश्यक आहे.

सॉफ्टवेअर प्रोजेक्ट्स:

प्रोजेक्ट सुरू करण्यापूर्वी 30% आगाऊ पेमेंट अनिवार्य आहे.
पहिल्या माइलस्टोन किंवा आंशिक डिलिव्हरी पूर्ण झाल्यावर 30% पेमेंट करणे आवश्यक आहे.
अंतिम प्रोजेक्ट डिलिव्हरीच्या वेळी शिल्लक 40% पेमेंट करणे आवश्यक आहे.

सामान्य पेमेंट नियम:

सर्व पेमेंट्स वरील वेळापत्रकानुसार असणे आवश्यक आहे, जोपर्यंत IT Educations द्वारे लेखी स्वरूपात अन्यथा मान्यता दिलेली नसेल.
जर ग्राहक एकूण पेमेंट तीन (3) पेक्षा जास्त हप्त्यांमध्ये विभागण्याची विनंती करतो, तर अशा व्यवस्थेस अतिरिक्त प्रशासनिक शुल्क किंवा दंड लागू होईल आणि प्रोजेक्टच्या विकास किंवा डिलिव्हरी वेळापत्रकात विलंब होऊ शकतो.
निर्धारित वेळापत्रकापेक्षा पेमेंट उशीर झाल्यास चालू काम थांबवले जाऊ शकते जोपर्यंत सर्व थकबाकी पूर्णपणे भरली जात नाही.
सर्व पेमेंट IT Educations द्वारे निर्दिष्ट केलेल्या अधिकृत पेमेंट पद्धतींनी (UPI, बँक ट्रान्सफर इ.) केले जाणे आवश्यक आहे.
जर ग्राहक किंवा विद्यार्थी 70% ते 80% पर्यंतचे प्रकल्प कार्य (अंशतः डिलिव्हरी, डेमो किंवा कोड ऍक्सेससह) घ्यायचे इच्छित असतील, तर त्यांना कोणत्याही वादाविना किंवा आक्षेपाशिवाय 100% एकूण पेमेंट आगाऊ करावे लागेल.

महत्त्वाचे:

सर्व पेमेंट्स कोणत्याही परिस्थितीत परतफेड किंवा समायोज्य नाहीत.
उशीर झालेल्या पेमेंट्समुळे प्रोजेक्ट उशीर होऊ शकतो किंवा अतिरिक्त शुल्क लागू होऊ शकते.

5. परत न होणारे देयक (Non-Refundable Payments)

IT Educations किंवा या फर्मच्या मालकाला केलेले सर्व देयक कोणत्याही परिस्थितीत परत न होणारे आणि न हस्तांतरित करता येणारे आहे, प्रोजेक्टची स्थिती, प्रगती, डिलिव्हरी टप्पा किंवा ग्राहकाचे समाधान यांची पर्वा न करता.
एकदा देयक केल्यानंतर ते अंतिम आणि बंधनकारक मानले जाईल आणि त्यात कोणताही बदल, रद्द करणे, समायोजन किंवा भविष्यातील प्रोजेक्ट, सेवा किंवा खात्यात हस्तांतरण करता येणार नाही.
नियम व अटी (Terms & Conditions) चा दुवा आमच्या UPI आणि इतर पेमेंट पृष्ठांवर स्पष्टपणे दर्शविला जाईल. पेमेंट करण्यापूर्वी या अटी वाचणे आणि समजून घेणे ही ग्राहकाची एकमेव जबाबदारी आहे.
जर ग्राहकाने नियम व अटी न वाचता पेमेंट केले, तर असे गृहित धरले जाईल की त्यांनी स्वेच्छेने सर्व अटी मान्य केल्या आहेत. पेमेंट पूर्ण झाल्यानंतर कोणताही वाद, परतफेड विनंती किंवा युक्तिवाद अवैध आणि अमान्य मानला जाईल.
पेमेंट सुरू करताना ग्राहक या सर्व अटींशी स्पष्टपणे सहमत होतो आणि पेमेंट किंवा रिफंडशी संबंधित कोणत्याही दाव्याचा, चार्जबॅकचा किंवा कायदेशीर आक्षेपाचा अधिकार त्यागतो.

6. तातडीच्या प्रोजेक्टसाठी शुल्क

1 ते 10 दिवसांत पूर्ण होणारे प्रोजेक्ट तातडीचे मानले जातील.
तातडीच्या प्रोजेक्टसाठी दुप्पट शुल्क आकारले जाईल कारण जास्त कामाचा ओझा आणि प्राधान्य वेळापत्रक लागते.
कंपनीला उपलब्धतेनुसार तातडीच्या प्रोजेक्ट नाकारण्याचा अधिकार आहे.

प्रोजेक्ट वर्कफ्लो

7. प्रोजेक्ट वितरण

अंदाजित वितरण वेळा प्रोजेक्ट प्लॅनमध्ये दिल्या जातील.
क्लायंटच्या उशीर झालेल्या सादरीकरणांमुळे किंवा अपूर्ण इनपुटमुळे वेळापत्रकावर परिणाम होईल.
तांत्रिक समस्या किंवा नैसर्गिक आपत्ती यांसारख्या अनपेक्षित घटनांमुळे वेळापत्रक प्रभावित होऊ शकते.
प्रोजेक्ट रिपोर्ट / थिसिस वितरण: अंतिम प्रोजेक्ट डिलिव्हरीनंतर 3–15 दिवसांच्या आत प्रोजेक्ट रिपोर्ट किंवा थिसिसची सॉफ्ट कॉपी दिली जाईल. रिपोर्ट / थिसिस सामान्य स्वरूपात असेल आणि 20–30 पानांपर्यंत मर्यादित असेल. या मर्यादेपेक्षा अधिक कस्टमायझेशन, अतिरिक्त मजकूर किंवा विशेष फॉरमॅटिंग साठी अतिरिक्त शुल्क आकारले जाईल. ₹10,000/- पेक्षा जास्त किंमतीच्या प्रोजेक्टसाठी (हार्डवेअर प्रोजेक्टच्या बाबतीत हार्डवेअर किंमत वगळून)च मोफत सॉफ्ट कॉपी दिली जाईल; यापेक्षा कमी किंमतीच्या प्रोजेक्टसाठी प्रोजेक्ट रिपोर्ट / थिसिसचे शुल्क आकारले जाईल.

8. बदल

लहान सुधारणा आणि योग्य समायोजने समाविष्ट आहेत.
मूळ कार्यक्षेत्राबाहेरील मोठे बदल अतिरिक्त शुल्क घेतील.
बदल विनंत्या मान्यताप्राप्त पुनरावलोकन कालावधीत करणे आवश्यक आहे.

9. प्रोजेक्ट कार्यक्षेत्र स्थिरता

एकदा प्रोजेक्ट कार्यक्षेत्र निश्चित झाल्यावर आणि पहिला टप्पा सुरू झाल्यावर, मोठे बदल कार्यक्षेत्र पुनरविचाराशिवाय मान्य नाहीत.
कोणतीही मोठी बदल विनंती केल्यास कार्यक्षेत्र पुनरावलोकन दस्तऐवज आणि अतिरिक्त खर्चाचा अंदाज तयार केला जाईल.

10. क्लायंट सुरू केलेले थांबे

जर क्लायंट प्रोजेक्ट 14 दिवसांपेक्षा जास्त थांबवतो, तर पुन्हा सुरू करण्यासाठी शुल्क लागू होऊ शकते.
30 दिवसांपेक्षा जास्त निष्क्रियतेच्या बाबतीत, प्रोजेक्ट रद्द मानला जाईल आणि कोणतीही परतफेड होणार नाही.

11. डिलिव्हरीनंतरची जबाबदारी आणि प्रोजेक्ट संग्रह

प्रोजेक्ट डिलिव्हरीनंतर उद्भवणाऱ्या कोणत्याही अडचणींसाठी (त्रुटी, डेटा गमावणे, हार्डवेअर/सॉफ्टवेअरची हानी इ.) IT Educations जबाबदार राहणार नाही.
सर्व प्रोजेक्ट डेटा, साहित्य आणि संसाधने केवळ शैक्षणिक आणि अकादमिक उद्देशासाठी दिली जातात. प्रोजेक्टचा व्यावसायिक, अनैतिक किंवा गैर-शैक्षणिक वापर केल्यास त्याची संपूर्ण जबाबदारी ग्राहकाची असेल.
प्रोजेक्ट किंवा त्याच्या कोणत्याही भागाचा दुरुपयोग अथवा अनधिकृत वापर केल्यामुळे उद्भवणाऱ्या कोणत्याही कायदेशीर, तांत्रिक किंवा आर्थिक परिणामांसाठी IT Educations जबाबदार राहणार नाही.
ग्राहकाने प्रोजेक्ट पूर्ण झाल्यानंतर त्वरित संग्रह करावा. उशीर झाल्यास अतिरिक्त साठवण किंवा हाताळणी शुल्क आकारले जाऊ शकते.

संप्रेषण व समर्थन

12. संप्रेषण व कार्यालयीन वेळा

प्रतिसाद वेळ 24–48 कामकाजी तास. त्वरित प्रतिसाद हमी नाही.
कामकाजी वेळेत रविवार आणि सार्वजनिक सुट्ट्या समाविष्ट नाहीत.
सुट्ट्यांमध्ये कॉल किंवा मेसेज केल्यास प्रोजेक्ट खर्चात ₹1000 दंड लागू होईल.

13. सहाय्य आणि देखभाल (डिलिव्हरीनंतर)

प्रोजेक्ट एकदा डिलिव्हर आणि मंजूर झाल्यानंतर, IT Educations कोणतेही मोफत सहाय्य, अपडेट किंवा बदल देण्यास बांधील राहणार नाही, जोपर्यंत ते प्रोजेक्ट स्कोप किंवा दस्तऐवजात स्पष्टपणे नमूद केलेले नसतील.
डिलिव्हरीनंतर कोणत्याही प्रकारचे तांत्रिक सहाय्य, समस्या निराकरण, बग फिक्सिंग, देखभाल किंवा फीचर सुधारणा हे सशुल्क सेवा म्हणून गणले जाईल आणि त्यासाठी IT Educations च्या विद्यमान दरांनुसार शुल्क आकारले जाईल.
डिलिव्हरीनंतर ग्राहकाने केलेल्या बदलांमुळे, तृतीय-पक्ष सॉफ्टवेअर, हार्डवेअर अपडेट्स किंवा प्रणालीतील बदलांमुळे उद्भवलेल्या समस्यांसाठी IT Educations जबाबदार राहणार नाही.
ग्राहकाने अंतिम स्वीकृतीपूर्वी प्रोजेक्टची सर्व कार्यक्षमता तपासून आणि मान्य करणे आवश्यक आहे, कारण डिलिव्हरीनंतर केलेल्या कोणत्याही बदलांसाठी किंवा पुन:कामासाठी अतिरिक्त शुल्क आकारले जाईल.

हार्डवेअर व तांत्रिक अटी

14. हार्डवेअर नुकसान आणि बदल

ग्राहक किंवा विद्यार्थी कोणत्याही हार्डवेअर नुकसान, दोष, जळणे किंवा काम न करणे यासाठी पूर्ण आणि एकटीची जबाबदारी असेल, अगदी प्रोजेक्ट कामाच्या दरम्यान झाल्यासही. अशा कोणत्याही नुकसानाची सर्व दुरुस्ती किंवा बदल खर्च ग्राहकाने स्वतः केला पाहिजे, कोणत्याही परिस्थितीत.
IT Educations कोणत्याही परिस्थितीत कोणत्याही नुकसानासाठी जबाबदार राहणार नाही, जे चुकीचा वापर, अयोग्य हाताळणी, चुकीची स्थापना, शॉर्ट सर्किट, व्होल्टेज उतार-चढाव, बाह्य पर्यावरणीय घटक किंवा आमच्या नियंत्रणाबाहेर असलेल्या कोणत्याही कारणांमुळे झाले असेल.
IT Educations द्वारे केलेला कोणताही बदल, दुरुस्ती किंवा सेवा सध्याच्या बाजार भावानुसार ग्राहकाकडून आकारली जाईल. IT Educations ला बदलाची पद्धत, विक्रेता किंवा सेवा प्रदाता निवडण्याचा एकाधिकार असेल, आणि ग्राहकांनी सुचवलेल्या पर्यायांसाठी कोणतीही जबाबदारी राहणार नाही.
ग्राहक मान्य करतो आणि सहमत आहे की जरी हार्डवेअर नुकसान प्रोजेक्ट कामाच्या दरम्यान झाले तरी, ते पूर्णपणे ग्राहकाची जबाबदारी असेल आणि IT Educations या घटनेसाठी कोणत्याही आर्थिक, कायदेशीर किंवा कार्यात्मक जबाबदारीस बाध्य होणार नाही.

15. घटक उपलब्धता व किंमत

सर्व हार्डवेअर घटकांची किंमत बाजारातील बदलांवर अवलंबून असते, आणि IT Educations कडे किंमती बदलण्याचा अधिकार आहे.
सप्लायर्स, शिपिंग, कस्टम क्लिअरन्स, आयात नियम किंवा बाह्य परिस्थितीमुळे घटकांच्या विलंबासाठी IT Educations जबाबदार नाही.
IT Educations कार्यक्षमतेसाठी समतुल्य किंवा उत्तम पर्याय निवडण्याचा अधिकार राखून ठेवतो.

मालकी व कायदेशीर अटी

16. मालकी व बौद्धिक संपत्ती

पूर्ण पेमेंट झाल्यानंतर अंतिम उत्पादनांची मालकी क्लायंटकडे हस्तांतरित केली जाईल.
गोपनीयता लिहिण्यात मागणी केल्याशिवाय, आम्ही प्रोजेक्ट आमच्या पोर्टफोलिओमध्ये दाखवू शकतो.

17. कोड आणि फाइल हस्तांतरण

18. गोपनीयता

सर्व गोपनीय माहिती काटेकोरपणे गोपनीय ठेवली जाईल.
कायद्याने आवश्यक नसल्यास, क्लायंटची कोणतीही माहिती तृतीय पक्षाशी शेअर केली जाणार नाही.

19. कायद्याचे पालन

प्रकल्पाच्या कायदेशीर पालनाची जबाबदारी क्लायंटवर आहे.
डिलिव्हरी नंतर प्रकल्पाचा गैरवापर किंवा बेकायदेशीर वापर यासाठी आम्ही जबाबदार नाही.

20. शैक्षणिक उपयोग अस्वीकरण

IT Educations द्वारे प्रदान केलेले सर्व प्रोजेक्ट, सामग्री, कोड आणि संसाधने केवळ शैक्षणिक आणि शिक्षणाच्या उद्देशांसाठी आहेत. यांचा कोणत्याही व्यावसायिक, फसवणूक किंवा गैर-शैक्षणिक उपक्रमांसाठी वापर केला जाऊ नये.
IT Educations कोणत्याही प्रकारच्या ग्रेड, गुण, प्रोजेक्ट मान्यता, शैक्षणिक मंजुरी किंवा निकाल याची हमी किंवा वॉरंटी देत नाही. प्रोजेक्टच्या वापरातून मिळणाऱ्या कोणत्याही शैक्षणिक मूल्यांकनाची किंवा निकालाची पूर्ण जबाबदारी ग्राहक किंवा विद्यार्थ्यावर असेल.
ग्राहक मान्य करतो आणि सहमत आहे की कोणत्याही प्रकारच्या गैरवापर, साहित्यिक चोरी (प्लेजरिझम), किंवा अनधिकृत सबमिशनमुळे उद्भवणाऱ्या कोणत्याही शैक्षणिक, कायदेशीर किंवा शिस्तभंग कारवाईची पूर्ण जबाबदारी ग्राहकाची असेल. IT Educations अशा घटनांसाठी कोणत्याही जबाबदारीसाठी बाध्य राहणार नाही.

विवाद आणि जबाबदारी

21. हमी आणि जबाबदारी

IT Educations सर्व प्रकारच्या हमी किंवा हमींचा स्पष्टपणे नकार देते, जसे की व्यावसायिकता, विशिष्ट उद्देशासाठी योग्यत्व, अचूकता, विश्वासार्हता किंवा बेकायदेशीरता यासंबंधी कोणतीही हमी.
प्रकल्पाची डिलिव्हरी झाल्यानंतर क्लायंट मान्य करतो की IT Educations प्रकल्पाच्या कार्यक्षमतेबद्दल किंवा निकालाबद्दल कोणतीही हमी देत नाही.
डिलिव्हरी नंतर उद्भवलेल्या कोणत्याही नुकसान, दोष, अपयश किंवा बिघाडासाठी IT Educations जबाबदार नाही, थेट किंवा अप्रत्यक्ष, डेटा, महसूल, नफा किंवा व्यवसाय संधींचा समावेश करून.
डिलिव्हर केलेल्या प्रकल्पाच्या ऑपरेशन, देखभाल आणि वापराबद्दल संपूर्ण जबाबदारी क्लायंटवर असेल.
प्रकल्प डिलिव्हरी नंतर कोड न चालणे, सॉफ्टवेअर दोष, हार्डवेअर अपयश, डेटा नुकसान किंवा नुकसान यासंबंधी कोणतीही तक्रार क्लायंटच्या जबाबदारीत येईल.

22. जबाबदारीची मर्यादा

आमची जबाबदारी फक्त क्लायंटने केलेल्या एकूण पेमेंटपर्यंत मर्यादित आहे.
हानी किंवा अप्रत्यक्ष नुकसान जसे की महसूल किंवा प्रतिष्ठेवर होणारी हानी यासाठी आम्ही जबाबदार नाही.

23. नुकसानभरपाई

प्रकल्पाचा गैरवापर किंवा कायद्याचे उल्लंघन झाल्यास क्लायंट आम्हाला कोणत्याही दाव्यांपासून नुकसानमुक्त ठेवेल.

24. विवाद निवारण

विवाद प्रथम चर्चा करून सोडवण्याचा प्रयत्न केला जाईल.
जर सोडवता आला नाही, तर मध्यस्थता किंवा न्यायालयापूर्वी मध्यस्थीकरण लागू होईल.

25. लागू कायदा

हे नियम नागपूर, भारताच्या कायद्याद्वारे नियंत्रित केले जातात.
न्यायप्राधिकरण नागपूर न्यायालयांमध्ये राहील.

इतर अटी

26. थेट कामासाठी कर्मचाऱ्यांना न मागणे

प्रकल्पादरम्यान आणि प्रकल्प पूर्ण झाल्यानंतर 12 महिन्यांपर्यंत क्लायंट आमच्या टीमला वैयक्तिक कामासाठी थेट कामावर घेणार नाही किंवा मागणी करणार नाही याची सहमती देतो.

27. फोर्स मेज्योर

नैसर्गिक आपत्ती, संप, इंटरनेट समस्या, महामारी इत्यादी अप्रत्याशित घटनांमुळे झालेल्या विलंबासाठी आम्ही जबाबदार नाही.

28. तृतीय-पक्ष अवलंबित्व

तृतीय-पक्ष API, होस्टिंग किंवा सेवांमध्ये अपटाइम, बंद होणे किंवा बदलांसाठी आम्ही जबाबदार नाही.

29. विनामूल्य डेमो नाही & बंद केल्यास शुल्क

वर्ग किंवा प्रकल्पासाठी कोणतेही विनामूल्य डेमो दिले जाणार नाहीत.
क्लायंटने प्रकल्प सुरू झाल्यानंतर बंद केल्यास अतिरिक्त शुल्क लागू होईल.

30. संवाद आणि व्यावसायिक वर्तन

IT Educations आणि क्लायंट यांच्यातील सर्व संवाद व्यावसायिक आणि आदरयुक्त असावेत.
IT Educations किंवा त्याच्या टीम सदस्यांबद्दल कोणत्याही प्रकारची अपमानास्पद भाषा, छळ किंवा गैरवर्तन झाल्यास प्रोजेक्ट तत्काळ रद्द केला जाईल आणि कोणताही परतावा दिला जाणार नाही.
अधिकृत वाद निराकरण प्रक्रिया न वापरता सोशल मीडियावर, ऑनलाईन रिव्ह्यू किंवा सार्वजनिक प्लॅटफॉर्मवर IT Educations बद्दल बदनामी करण्याचा कोणताही प्रयत्न मानहानी समजला जाईल आणि त्यावर कायदेशीर कारवाई व आर्थिक दंड होऊ शकतो.

31. गोपनीय काम आणि अप्रकटीकरण

क्लायंटने IT Educations ची लेखी परवानगी घेतल्याशिवाय कोणतेही प्रोजेक्ट डिलिव्हरेबल शेअर, पुनर्विक्री, पुनरुत्पादन, वितरण किंवा सार्वजनिकरित्या प्रदर्शित करू नये.
आमच्या मालकीच्या साहित्याचा (PPT, रिपोर्ट, सोर्स कोड, प्रोजेक्ट व्हिडिओ किंवा तांत्रिक सामग्री) अनधिकृत वापर किंवा वितरण झाल्यास भारतीय IT आणि बौद्धिक संपदा कायद्यांनुसार कारवाई केली जाईल.

32. गैरवापर, फसवणूक किंवा शैक्षणिक बेईमानी

IT Educations कोणत्याही प्रकारच्या शैक्षणिक फसवणुकीला, चोरीला किंवा बनावट सादरीकरणाला पाठिंबा देत नाही.
क्लायंटने प्रोजेक्टचा वापर संस्थात्मक किंवा कायदेशीर नियमांचे उल्लंघन करून केला तर IT Educations वापर अधिकार रद्द करण्याचा, क्लायंटला ब्लॅकलिस्ट करण्याचा आणि संबंधित संस्थेला कळविण्याचा अधिकार राखून ठेवतो.

33. संवाद नोंदी

प्रोजेक्टशी संबंधित सर्व संवाद (चॅट, ईमेल, कॉल इ.) अधिकृत नोंद म्हणून मानले जातील.
वादाच्या स्थितीत फक्त लेखी संवाद (ईमेल किंवा नोंदणीकृत चॅट) वैध पुरावा म्हणून ग्राह्य धरला जाईल.
तोंडी चर्चा किंवा फोन कॉल लेखी पुष्टीशिवाय वैध मानली जाणार नाही.

34. मीडिया हक्क आणि पोर्टफोलिओ वापर

IT Educations ला आपल्या पोर्टफोलिओ, प्रचार किंवा शैक्षणिक हेतूसाठी प्रोजेक्टच्या काही भागांचे दस्तऐवजीकरण, स्क्रीनशॉट किंवा रेकॉर्डिंग करण्याचा अधिकार आहे, जोपर्यंत क्लायंटने गोपनीयतेसाठी लेखी विनंती केलेली नसते.

35. प्रोजेक्ट सोडून देणे

जर क्लायंटने सलग 30 दिवस प्रतिसाद, पेमेंट किंवा आवश्यक माहिती दिली नाही तर प्रोजेक्ट सोडून दिलेला मानला जाईल.
सोडलेले प्रोजेक्ट आपोआप बंद केले जातील आणि कोणताही परतावा किंवा पुढील सेवा दिली जाणार नाही.
अशा प्रोजेक्टला पुन्हा सुरू करण्यासाठी एकूण प्रोजेक्ट किंमतीच्या 25% पर्यंत पुनःप्रारंभ शुल्क आकारले जाईल.

36. कायदेशीर कारवाई आणि वसुली

पेमेंट न केल्यास, कराराचे उल्लंघन, बदनामी किंवा डिलिव्हरेबल्सचा गैरवापर झाल्यास IT Educations भारतीय करार अधिनियम 1872 आणि माहिती तंत्रज्ञान अधिनियम 2000 अंतर्गत नागरी किंवा फौजदारी कारवाई करू शकते.
वसुलीसाठी येणारे सर्व कायदेशीर किंवा इतर खर्च पूर्णपणे क्लायंटनेच वहन करावेत.

37. क्लायंट अभिप्राय आणि प्रशंसापत्र वापर

क्लायंटने स्वेच्छेने दिलेला कोणताही अभिप्राय किंवा प्रशंसापत्र IT Educations च्या मार्केटिंग आणि प्रचारासाठी वापरला जाऊ शकतो.
क्लायंटला त्याची सामग्री काढून टाकण्यासाठी लेखी विनंती करता येईल.

38. गुणवत्ता हमीची मर्यादा

IT Educations हे सुनिश्चित करते की प्रोजेक्ट ठरलेल्या व्याप्तीनुसार कार्यक्षम आणि अचूक असेल, परंतु खालील गोष्टींची हमी देत नाही:

100% बग-फ्री कामगिरी,
सर्व प्रणाली किंवा उपकरणांशी सुसंगतता, किंवा
संस्थात्मक स्वीकृती किंवा गुण मिळणे.

सर्व प्रोजेक्ट फक्त शैक्षणिक उद्देशासाठी “जैसे थे” आधारावर दिले जातात.

39. डिजिटल स्वाक्षरी आणि इलेक्ट्रॉनिक करार

ईमेल, फॉर्म सबमिशन किंवा पेमेंटद्वारे या दस्तऐवजाची स्वीकृती ही भौतिक स्वाक्षरीइतकीच कायदेशीर मानली जाईल.
क्लायंटची डिजिटल स्वीकृती ही सर्व कायदेशीर, प्रशासकीय आणि कार्यात्मक बाबींमध्ये संमतीचा पुरावा मानली जाईल.

40. डेटा बॅकअप आणि सायबर सुरक्षा अस्वीकरण

अंतिम डिलिव्हरीनंतर डेटा हरवल्यास IT Educations जबाबदार राहणार नाही. क्लायंटने स्वतः सर्व डिलिव्हरेबल्सचा बॅकअप ठेवावा.
आम्ही हॅकिंग, डेटा चोरी किंवा तृतीय पक्ष हल्ल्यांपासून संपूर्ण सुरक्षा हमी देत नाही.

41. स्वीकृती (Acceptance)

नियमांची मान्यता

IT Educations कडून कोणतीही सेवा (प्रकल्प कार्य, प्रशिक्षण किंवा मार्गदर्शन) घेण्यापूर्वी किंवा त्यात सहभागी होताना ग्राहक किंवा विद्यार्थी हे मान्य करतात की त्यांनी सर्व नियम व अटी वाचल्या, समजल्या आणि त्यांना स्पष्टपणे सहमती दिली आहे.

अंतर्निहित सहमती

IT Educations द्वारे दिल्या जाणाऱ्या कोणत्याही सेवेमध्ये सुरुवात, सातत्य किंवा सहभाग हा ग्राहक किंवा विद्यार्थ्याची या सर्व अटी व शर्तींना दिलेली पूर्ण आणि बिनशर्त स्वीकृती मानली जाईल. ग्राहक किंवा विद्यार्थी यांना कोणत्याही कलमाबद्दल संशय, हरकत किंवा आरक्षण नाही, याची पुष्टी करतात.

दाव्यांवरील त्याग

सेवा सुरू झाल्यानंतर, IT Educations कोणत्याही ग्राहक किंवा विद्यार्थ्यांकडून गैरसमज, अज्ञान किंवा चुकीच्या अर्थामुळे आलेले दावे, वाद किंवा हरकती स्वीकारणार नाही.

एकदा सेवा, प्रकल्प किंवा कार्य सुरू झाल्यावर हे मानले जाईल की ग्राहक किंवा विद्यार्थ्याने सर्व नियम व अटी वाचल्या आहेत, समजल्या आहेत आणि त्यांना स्पष्टपणे सहमती दिली आहे. जर सेवेसाठी आवश्यक तपशील किंवा नोंदणी फॉर्म दिला गेला नाही, तर त्याची जबाबदारी ग्राहक किंवा विद्यार्थ्याची स्वतःची राहील आणि त्यामुळे झालेल्या कोणत्याही विलंब, समस्या किंवा वादासाठी IT Educations जबाबदार राहणार नाही.

नियमांमध्ये बदल करण्याचा अधिकार

IT Educations ला कोणत्याही वेळी, कोणतीही पूर्वसूचना न देता या नियमांमध्ये बदल, सुधारणा किंवा अद्ययावत करण्याचा पूर्ण अधिकार आहे.

सततची स्वीकृती

IT Educations कडून दिल्या जाणाऱ्या सेवेमध्ये सतत सहभाग हे या सर्व सुधारित अटी व शर्तींचे पूर्ण आणि बंधनकारक पालन मानले जाईल.

कोणतीही सेवा (प्रकल्प, प्रशिक्षण किंवा मार्गदर्शन) पुढे सुरू ठेवून ग्राहक किंवा विद्यार्थी हे सर्व नियम आणि अटी पूर्णपणे स्वीकारत आहेत, हे ते पुष्टी करतात.

IT Educations शी संबंधित सर्व ग्राहक आणि विद्यार्थी हे मान्य करतात की त्यांनी कोणतीही सेवा, व्यवहार किंवा प्रकल्प सुरू करण्यापूर्वी या अटी काळजीपूर्वक वाचल्या, समजल्या आणि स्वेच्छेने स्वीकारल्या आहेत. ही स्वीकृती डिजिटल स्वाक्षरी, इलेक्ट्रॉनिक पुष्टी, चेकबॉक्स सहमती किंवा ईमेल पुष्टी द्वारे दिल्यास ती कायदेशीर बंधनकारक राहील.

या अटींशी संबंधित कोणताही वाद, दावा किंवा मतभेद फक्त नागपूर, महाराष्ट्र (भारत) येथील सक्षम न्यायालयांच्या अधिकारक्षेत्रात सोडविला जाईल. इतर कोणत्याही ठिकाणी कायदेशीर कारवाई करता येणार नाही.

पेमेंट करून, प्रकल्प सुरू करून किंवा सेवा वापरून ग्राहक किंवा विद्यार्थी अपरिवर्तनीय सहमती देतात की ते IT Educations द्वारे ठरविलेल्या सर्व अटी व धोरणांचे पालन करतील.

IT Educations ला कोणतीही पूर्वसूचना न देता या अटींमध्ये बदल, सुधारणा किंवा अद्यतन करण्याचा अधिकार आहे आणि हे बदल विद्यमान व भविष्यातील सर्व ग्राहक व विद्यार्थ्यांवर लागू राहतील.
